Derivative works must always seek permission (unless rights are given up, as with Creative Commons licenses and that kind of stuff).

Thus why everyone should be using the Can Haz Cheezburger site thing because every submitted photo is under the Creative Commons!

If you post it on a blog, you can't complain about it being "ripped" by a "friend" to be used on another site you host. Come on, that is just silly 

If anything, you should ask the person in the picture for explicit permission no?

a) The tongue-sticking-out should show you that I'm not being entirely serious here (though you're obviously having a good Monday)

b) The permission from Decayus is implied when I take a photo (and I also told him that it would be publicly visible, if you prefer explicit).

I think whether you (as in Kage) ask him for permission on future edits/publication is kind of nebulous -- it's certainly good form to ask a celebrity before you put words in his mouth. Some celebs demand that magazines show them the entire work/quotes/pictures before they are published -- I guess that's in the contract, when they agree to photo shoots/interviews.
